Defense Contractor Going to Prison For Selling Fraudulent Goods to U.S. Military

A former defense contractor is going to federal prison for selling fraudulent goods to the United States military.

Timothy W. Foley, of California, was sentenced to three months in prison for his criminal activity. Foley's case was heard in the U.S. District Court in Columbus, Ohio. Foley was also ordered to pay restitution of more than $1.3 million to the U.S. Department of Defense.

Per an official release from the IRS, Foley operated and co-owned Parts Source International Inc. in Goleta, California. Parts Source was a defense contractor that "sold and supplied a variety of military parts to the DoD for use on military weapons systems, and some of which were critical application items, and invoiced the Defense Finance and Accounting Service (DFAS) in Columbus, Ohio, for payment."

Foley acknowledged that between 2012 and 2019, he worked with a co-conspirator, Jimmy Daryl Thomas, of White House, Tennessee, to supply the DoD with fraudulently manufactured, non-conforming goods. He submitted 131 purchase order quotes confirming that he would provide the exact part requested by military officials. In reality, Foley delivered unapproved substitutions in fake packaging. 

Once this was discovered via testing, the military could not use any parts, totaling $1.36 million in payments. 

In November 2022, Foley pleaded guilty to conspiring to commit wire fraud and to money laundering. Thomas was sentenced to two months in prison and three years of supervised release in May 2023. He was involved in at least 29 of the 131 contracts for which fraudulent parts were provided to the DoD.

U.S. Attorney Kenneth L. Parker said, “Behavior such as this, from individuals putting profit over the safety of the dedicated men and women in our military, will not be tolerated. When we find individuals supplying fraudulent items to the U.S. military, we will address these illegal acts as the serious crimes they are."

Patrick J. Hegarty, Special Agent in Charge of the DCIS Northeast Field Office, also spoke out, “Protecting the integrity of the U.S. Department of Defense (DoD) supply chain is a priority for the Defense Criminal Investigative Service (DCIS), the law enforcement arm of the DoD Office of Inspector General."

“The introduction of defective parts into the DoD supply chain endangers the lives of American service members and threatens our military readiness. The DCIS is committed to working with the U.S. Attorney's Office, Southern District of Ohio, the Defense Logistics Agency, and our law enforcement partners to ensure that individuals who engage in fraudulent activity, at the expense of the U.S. military, are investigated and prosecuted," he concluded. 

Internal Revenue Service Criminal Investigation (IRS-CI) and the Defense Finance and Accounting Service (DFAS) were heavily involved in investigating this case.
